What are the requirements for adoption?

Are you considering adoption? Adopting a child into your home is a very important action for you and the child involved. It must be the right thing for you and the child. Eligibility to apply to adopt a child?

In the UK, you need to be living in the UK for at least a year, the bear minimum requirement to be successful in the adoption application process. You also need a DBS /police clearance to be declared an appropriate person to raise a child.  Then you need to apply for an adoption court order either through an adoption agency or through the Council.  This will be heard in a family court. If your application is successful, you can obtain an adoption certificate.

Inter-country adoptions

The immigration rules and guidance need careful consideration if you intend to adopt a child from overseas.The duty in section 55 of the Borders, Citizenship and Immigration Act 2009 requires officers of the court to have regard for the need to safeguard and promote the welfare of a child in the UK.  The welfare of the child

Article 8 of the European Convention on Human Rights (ECHR), states that everyone has a right to a private and family life. However, authorities will consider whether the rights of the child are a central part of the application process. It can decide whether the adoption is in the child’s best interest. The application process can fail on these grounds if the rights of the child are compromised. An example of this is that the child’s mental health deteriorates because he/she is separated from his cultural environment. This is also expressed in Article 3 United Convention on the Rights of the Child.
